These Terms and Conditions ("Terms") govern your access to and use of the website www.farmery.cloud, the Farmery mobile applications and related services (together, the "Platform") operated by Farmery ("Farmery", "we", "us" or "our"). By accessing, browsing, registering on or placing an order through the Platform, you agree to be bound by these Terms, our Privacy Policy, our Return & Refund Policy and our Shipping Policy. If you do not agree, please do not use the Platform.
1. Eligibility
You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Platform and place orders.
2. Account & Registration
You may register using your mobile number and one-time password (OTP). You are responsible for maintaining the confidentiality of your account and for all activities under it. You agree to provide accurate, current and complete information. We may suspend or terminate accounts that contain false information or are used in breach of these Terms.
3. Products, Pricing & Availability
All products are subject to availability. Prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. As our produce is fresh and seasonal, prices, weights and availability may vary. We reserve the right to correct errors, and to change or discontinue products and prices at any time without prior notice.
4. Orders & Acceptance
Your order is an offer to purchase. An order confirmation acknowledges receipt of your order but does not constitute acceptance. A contract is formed only when we confirm dispatch of the products. We reserve the right to accept or reject any order, including for reasons of pricing errors, product unavailability, suspected fraud, or delivery constraints.
5. Payments
Payments may be made online through our RBI-authorised, PCI-DSS compliant payment gateway partners (credit/debit card, net banking, UPI, wallets) or by Cash on Delivery where available. For prepaid orders, payment must be completed before dispatch. We do not store your card, UPI or banking credentials. By making a payment you agree to the terms of the relevant payment gateway.
6. Delivery
We currently deliver across Delhi, Gurugram, Ghaziabad, Noida, Greater Noida and Meerut (Delhi-NCR). Delivery timelines are estimates and may vary. Please refer to our Shipping Policy for details. Risk and title in the products pass to you upon delivery.
7. Cancellations & Refunds
Cancellations and refunds are governed by our Return & Refund Policy, which forms part of these Terms.
8. User Conduct
You agree not to:
- Use the Platform for any unlawful, fraudulent or harmful purpose;
- Upload or transmit content that is defamatory, obscene, infringing or otherwise objectionable;
- Attempt to gain unauthorised access to, interfere with, or disrupt the Platform or its systems;
- Use automated means (bots, scrapers) to access or copy any part of the Platform; or
- Resell products purchased from the Platform without our written consent.
9. Intellectual Property
All content on the Platform — including the Farmery name, logo, text, graphics, images and software — is owned by or licensed to Farmery and is protected by applicable intellectual property laws. You may not use, copy or reproduce it without our prior written consent.
10. Disclaimers & Limitation of Liability
The Platform and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied. We shall not be liable for any indirect, incidental or consequential loss. Our total liability for any claim arising out of an order shall not exceed the amount paid by you for that order. Nothing in these Terms limits your statutory rights as a consumer under the Consumer Protection Act, 2019.
11. Indemnity
You agree to indemnify and hold harmless Farmery, its affiliates, directors, employees and partners from any claims, losses or damages arising out of your breach of these Terms or your violation of any law or the rights of a third party.
12. Force Majeure
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, strikes, government actions, or disruptions to supply, logistics or communications networks.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India. The courts at New Delhi, India shall have exclusive jurisdiction over any dispute arising out of or in connection with the Platform.
14. Grievance Redressal
For any complaint or grievance, you may contact our Grievance Officer at support@farmery.in or +91 98997 79559. We aim to acknowledge complaints within 48 hours and resolve them within 30 days.
15. Changes to These Terms
We may amend these Terms at any time. Changes are effective when posted on this page. Your continued use of the Platform constitutes acceptance of the amended Terms.
